Arlo & Co Privacy Policy (Effective Date: 25/05/2018)

This Privacy Policy describes the practices that Arlo & Co (referred to as “Arlo & Co” or “we”) follows with respect to the collection, use, maintenance and disclosure of information collected through the website www.arloandco.com.au (the “Site”). By using our Site, you consent to the collection, use, processing, maintenance and disclosure of this information by us.

Information We Collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.

Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

   - “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. Cookies help us to facilitate your shopping process, including making it possible for us to store information regarding your design, image, text and other selections for our products that you are personalising, and the contents of your shopping cart. By doing this, we can custom tailor your experience and save you time during checkout. It’s possible to prevent cookies from being used by your browser.    - “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

   - “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

  • Shopify tracks and assesses your payment information to screen for fraudulent activity

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, email address, phone number, and the information you use to personalise our products - including text, photographs, and other images (i.e. technical information about those photographs and images, such as the file size and aspect ratio).

Payment information (including credit card numbers and paypal account details) is also collected, however this is not stored by us and is accepted through a secure payment gateway.

We refer to this information as “Order Information.”

We also collect additional personal information when volunteered by you, such as information provided in surveys, blog/social media comments, over the phone, and emails.

When we talk about “Personal Information” in this Privacy Policy, we are talking about Device Information, Order Information, and additional personal information volunteered by you.

You can choose not to provide Personal Information to us. However, if you do not provide such information, you may not be able to make a purchase or create an account with Arlo & Co, so your ability to use the Site will be limited.

Do Not Track Disclosures

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

Processing Your Personal Information

We process Personal Information for certain legitimate business purposes, which include some or all of the following:

  • Where the processing enables us to enhance, modify, personalise or otherwise improve our services/communications for the benefit of our customers;
  • To enhance the security of our network and information systems;
  • To better understand how people interact with our website, paid advertising, and social media channels; and
  • To determine the effectiveness of promotional campaigns and advertising and iterate these to be more relevant to our customers.

a. Order Information

We process the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

  • Communicate with you;
  • Screen our orders for potential risk or fraud; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

When you place your order, we store photographs, images and other content uploaded or submitted to the Site - and information about any such photographs and images - in order to provide products and customer service, improve our products and customer service, garner insights and information about our users, and to fulfill orders as mentioned above. Our printing, cutting, and assembly process requires human involvement, so Arlo & Co employees will see your photographs, images, and other content that you submit to the Site.

We may sometimes use finished products with our customer’s photographs, images or content on our website and social media channels for marketing purposes. If you do not wish for products with your photographs, images or content to be used on our website and social media channels for marketing purposes, please let us know once you place your order and have the order number of the products you wish not to be used in this way. You can email hello@arloandco.com.au with the subject line “Do not share my order” and your order number, and we’ll make sure your products from that order don’t get used on our website and social media channels for marketing purposes.

b. Device Information

We process the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimise our Site and customer experience (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

c. Promotions And Surveys

Every now and then, Arlo & Co may also invite customers to take part in surveys, promotions, contests and sweepstakes. The information we collect from these surveys, promotions, contests, and sweepstakes may be matched with individual customer accounts and used by Arlo & Co to contact you regarding our surveys, promotions, contests and sweepstakes and to improve your overall customer experience, and may be shared with third parties who provide services to us or on our behalf.

Whenever we process data for the purposes above we will ensure that we always keep your Personal Data rights in high regard and take account of these rights. You have the right to object to this processing if you wish - simply email us at hello@arloandco.com.au with your objection. Please just note that if you object, this may affect our ability to carry out the tasks above for your benefit.

Sharing Your Personal Information

If you have created an account with Arlo & Co, you may review, update, or correct personal information submitted in connection with that account by contacting us at hello@arloandco.com.au or calling us on (+61) 03 9070 8156. If you request that Arlo & Co delete your account and information, we will use reasonable efforts to deactivate your account and delete your personal information in a timely manner, unless we are required to retain such information by law, or we reasonably believe we need to retain such information for business purposes, which will be discussed with you.

You can also opt-out of our marketing correspondence at any time via the unsubscribe links found in every Klaviyo email you receive from Arlo & Co.

We do reserve the right to send you certain communications relating to the goods and services Arlo & Co provides, such as updates to our Terms of Service or Privacy Policy, service/product announcements, administrative messages, or messages regarding any order you placed. We do not offer you the opportunity to opt-out of receiving certain messages, including order confirmations and shipping notifications, however, once you have received your order, you are welcome to contact us at hello@arloandco.com.au to delete your information from our records.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Behavioural Advertising

Your Rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including here in Australia, and to Canada and the United States.

Data Retention

Any information, photographs, images or other content we collect will be transferred to and stored in our servers or those of third parties that act on our behalf (such as hosting providers) in the USA or elsewhere. By using our services you agree to such collection, transfer and storage.

We retain Personal Information where we have an ongoing legitimate business or legal need to do so. Our retention periods will vary depending on the type of data involved, but, generally, we'll refer to these criteria in order to determine retention period:

  • Whether we have a legal or contractual need to retain the data.
  • Whether the data is necessary to provide our service.
  • Whether our users have the ability to access and delete the data within their Arlo & Co accounts.
  • Whether our users would reasonably expect that we would retain the data until they remove it or until their Arlo & Co accounts are closed or terminated.

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymise it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

Please note, Arlo & Co does not operate as storage repository for your images or other content. If desired, you should make your own back-up and archival copies of any content, including images, that you upload or otherwise submit to the Site. We will not be liable to you for any loss of images or content.

Privacy Of Children

The Site is a general audience website. We do not intentionally collect personal information from users of this Site who are under the age of sixteen. If we become aware that a user of our Site is under the age of 16 and has placed an order using our Site, we will remove that child’s personal information from our files.

Internet Security

Information transmitted on the Internet and/or stored on systems attached to the Internet is not 100% secure. As a result, we do not ensure, warrant or guarantee the security or integrity of such information. We will not be responsible for disclosure of any information due to errors in transmission or the unauthorized acts of third parties.

You help to maintain the security of your personal information stored in our systems by keeping your Personal Information confidential and protecting against unauthorised access to your password (if you have an account if us) and to your computer. Be sure to sign off when finished using a shared computer.

Third Party Sites

Our Site will contain links to other websites for news and other information. Our Privacy Policy only applies to our Site, and we are not responsible for the privacy practices or the content of other websites which are linked to or integrated with our Site. You should check the privacy policies of those sites before providing your personal information to them.

Changes/Updates To The Privacy Policy

We reserve the right to revise this policy at any time. When we do, we will give you notice of the revised Privacy Policy by posting the revised Privacy Policy on the Site and by revising the “effective date” at the top of this Privacy Policy.
